UNEMPLOYMENT APPLICATION/HEARING/APPEAL PROCESS MADE SIMPLY
In Colorado, like most states, unemployment insurance benefits are available to certain unemployed workers. An applicant can receive up to about $435 per week. To this, the federal government adds about $25 per week. These numbers represent typical maximum amounts available. Some worker may not be eligible for the full amount, depending on their former earnings and other factors.
Nevertheless, unemployment benefits may pay up to nearly $25,000 per year. Such benefits can provide a good financial “bridge” to allow someone who is unemployed to meet most or all of their basic financial necessities. This benefit is considerable and should be protected.
Recently, the term (length of time) for receiving unemployment insurance benefits was extended from 26 to 52 weeks through the awarding of supplemental benefits. There are additional tiers and emergency benefits for eligible applicants which may make unemployment benefits available for up to 99 weeks, depending on a variety of factors, such as a persistently high overall unemployment. Over two years, an applicant could collect nearly $5000 in benefits. Again, this benefit is a considerable amount of money and should be taken very seriously.
In most states, including Colorado, an applicant for unemployment insurance benefits can use the automated phone system or they can apply online. Usually, the claimant’s claim will be approved, and he/she will start receiving compensation automatically. This decision is made by an entry-level fact finder, such as a Deputy.
However, if the employer controverts (opposes) the claim, benefits for the applicant will terminate immediately and a hearing will be scheduled before a Hearing Officer. The applicant still must make biweekly phone calls to the unemployment division even when awaiting a final decision in order to be eligible for back-pay and/or continued benefits.
Both the employee/claimant and the employer/respondent may be represented if they wish, and they are responsible for their own costs of representation. Employers almost always elect to be represented by a representative. A person’s representative may be a lawyer or a non-lawyer.
